October 2011 OHSAA Board of Directors Meeting – Summary of Infractions and Penalties

The OHSAA imposed the following penalties against schools that violated OHSAA bylaws or sports regulations:

1. Dublin Sells Middle School’s boys and girls golf teams each had a student-athlete violate Sports Regulation 6.4 when they participated in a non-interscholastic event while a member of the school’s golf teams. In accordance with Sports Regulation 6.13.1, Penalties, the OHSAA ruled the students ineligible for the school’s next two contests and, in accordance with Bylaw 10-2-5, Forfeitures, the school must forfeit all contests in which the ineligible students participated after the violation occurred and before the suspensions began along with the student’s points and records. However, all eligible participants may keep their points and records from those contests.

2. Cincinnati Taft High School’s varsity football team had five student-athletes ruled ineligible for interscholastic athletics for one year from the date of transfer to Taft because the Commissioner’s Office determined that none of the enumerated exceptions to Bylaw 4-7-2, Transfers, were applicable. After the school received this ruling from the OHSAA, the school’s head coach disregarded the ruling and played the students in the school’s first contest, which was televised nationally on one of the ESPN channels. Although Taft lost that contest, in accordance with Bylaw 11-1-2, Penalties, the OHSAA suspended the head coach for the school’s next five contests, the school has been placed on probation for two years and the school has been fined $2,500.

3. Columbus Ridgeview Middle School’s volleyball team had a student-athlete violate Sports Regulation 6.4 when she participated in a non-interscholastic event while a member of the school’s volleyball team. In accordance with Sports Regulation 6.13.1, Penalties, the OHSAA ruled the student ineligible for the school’s next two contests and, in accordance with Bylaw 10-2-1, Forfeitures, the school must forfeit all victorious contests in which the ineligible student participated after the violation occurred and before the suspension began.

4. New Concord John Glenn High School’s girls soccer team had a student-athlete violate Bylaw 4-3-1, Exception 3, Enrollment and Attendance. In accordance with Bylaw 10-2-1, Forfeitures, the school must forfeit all victorious contests in which the ineligible student participated.

5. Parma Normandy High School’s ice hockey team permitted an eighth-grade student to participate in practices during the 2010-11 season and a parent made contact with another eighth-grade student during the summer. In accordance with Bylaw 11, Penalties, the school’s head coach has been reprimanded, the school’s ice hockey program has been placed on probation for one year and a school administrator is required to attend three OHSAA meetings where bylaws and compliance issues are reviewed in the spring and summer of 2012.

6. The Dayton Public Schools had a student transfer this fall to Ponitz Career Technology Center in accordance with the requirements of Bylaw 4-7-6, Transfer of Public High School Students Prior to the Beginning of the School Year. The student is compliant with the bylaw but the district failed to request an eligibility ruling within the first 15 days of the school year as required. The OHSAA restored eligibility but, in accordance with Bylaw 4-1-1, Administrative Error, the district has been fined $150.

7. The OHSAA has concluded an investigation that began last winter on information it received regarding alleged rules infractions at Canal Winchester Harvest Preparatory School. The OHSAA met with representatives of the school and mutually worked to reach a resolution that includes several sanctions after it has been determined that OHSAA bylaws on scholarship, transfers, recruiting and administrative responsibility have been violated. The agreed sanctions include suspension of Harvest Prep School from participation in the Association's post-season tournaments in football, girls basketball and boys basketball for the 2011-12 and 2012-13 academic years. The school also will be ineligible for post-season play for the 2011-12 academic year in all other sports. Following the 2012-13 academic year, Harvest Prep will serve a three-year period of probation. In addition, Harvest Prep will forfeit the 2011 district and regional championships and state runner-up in boys basketball along with all victorious contests from the 2010-11 boys basketball season because an ineligible player participated. Three games from the 2010 football season, in which another ineligible student participated, also have been forfeited. Harvest Prep has also agreed to pay a fine and the cost of the OHSAA's investigation. In addition, the school has hired an independent administrator that was selected by the OHSAA to oversee the school's compliance with OHSAA bylaws and regulations. The administrator, who will work at Harvest Prep through June 2013, will provide updates and progress reports to the OHSAA Office. Harvest Prep will be permitted to maintain its regular season schedules during the probation period but, in the event the OHSAA finds additional major violations of Association bylaws, the school's membership status in the OHSAA could be in jeopardy.

8. Lima Perry High School’s football team had a student-athlete violate Bylaw 4-7-2, Transfers, and, in accordance with Bylaw 11-2-1, Forfeitures, the school must forfeit one victorious contest in which the ineligible student participated.

Might have to update this unfortunately sooner than later. It is not a good thing when the Lima community has as much controversy as that of the larger Ohio cities.
